1. Acceptance of Terms
These Terms of Service (the “Terms”) form a binding
agreement between you and Stoara (“Stoara”, “we”, “us”).
By accessing or using any of our websites, applications, or
related services (collectively, the “Services”), you
agree to these Terms. If you do not agree, do not use the
Services.
2. Eligibility
You must be at least 13 years old, or the minimum age of
digital consent in your jurisdiction, to use the Services. If
you use the Services on behalf of an organization, you
represent that you have authority to bind that organization
to these Terms.
3. Accounts
Some Services require an account. You are responsible for
maintaining the confidentiality of your account credentials
and for all activity that occurs under your account. Notify us
promptly at
support@stoara.com if
you suspect unauthorized use.
4. License to use the Services
Subject to your compliance with these Terms, Stoara grants you
a personal, non-exclusive, non-transferable, revocable license
to install and use our applications on devices you own or
control, and to access our web Services for your own use.
This license does not include any right to resell or
commercially exploit the Services, to copy or distribute the
applications outside of authorized stores, or to reverse
engineer them except to the extent permitted by applicable law.
5. Acceptable use
You agree not to:
- Use the Services in violation of any law or regulation;
- Interfere with or disrupt the Services or the networks they run on;
- Attempt to gain unauthorized access to any account, system, or data;
- Use the Services to send unsolicited communications, malware, or to harvest user information;
- Misrepresent your identity or affiliation in connection with the Services.
6. Purchases & subscriptions
Some Services are sold for a one-time fee; others are offered
on a subscription basis. Prices, billing intervals, and
renewal behaviour are disclosed at the point of purchase.
Where you purchase through the Apple App Store, Mac App Store,
or another authorized platform, that platform’s payment,
refund, and subscription-management terms apply in addition to
these Terms. We are not the merchant of record for those
transactions and cannot directly issue refunds for them; please
use the platform’s built-in refund process.
7. Third-party platforms
The Services may be distributed through, or integrate with,
third-party platforms (such as the Apple App Store). Your use
of those platforms is subject to their own terms. Stoara is not
responsible for the availability, accuracy, or content of
third-party platforms or for any action taken by them in
relation to your account or purchases.
8. Your content
Some Services let you create, upload, or store content (“Your
Content”). You retain ownership of Your Content. You grant
Stoara a limited license to host, process, and transmit Your
Content solely as necessary to provide the Services to you.
You are responsible for ensuring that Your Content does not
violate any law or any third-party rights. We may remove
content that violates these Terms or applicable law.
9. Intellectual property
The Services, including the underlying software, designs,
trademarks, and content provided by Stoara, are owned by
Stoara or its licensors and are protected by intellectual
property laws. Except for the license expressly granted in
Section 4, no rights are transferred to you.
“Stoara” and the Stoara wordmark are trademarks of Stoara.
You may not use them without our prior written permission,
except to refer to the Services factually.
10. Termination
You may stop using the Services at any time. We may suspend or
terminate your access if you violate these Terms, if required
by law, or if we discontinue a Service. Sections that by their
nature should survive termination (including 8–13) will
survive.
11. Disclaimers
The Services are provided “as is” and “as available”.
To the maximum extent permitted by law, Stoara disclaims all
warranties, express or implied, including merchantability,
fitness for a particular purpose, and non-infringement.
12. Limitation of liability
To the maximum extent permitted by law, Stoara will not be
liable for any indirect, incidental, special, consequential, or
punitive damages, or for any loss of profits or revenues,
whether incurred directly or indirectly. Our aggregate
liability arising out of or in connection with the Services
will not exceed the greater of (a) the amount you paid Stoara
in the twelve months before the event giving rise to the
claim, or (b) one hundred US dollars (US$100).
13. Governing law & disputes
These Terms are governed by the laws of the State of Texas
and the United States of America, without regard to conflict
of laws principles. The parties agree to resolve any disputes
in the state and federal courts located in Collin County,
Texas (McKinney), except that either party may seek injunctive
relief in any court of competent jurisdiction.
14. Changes to these Terms
We may update these Terms from time to time. When we make
material changes, we will update the effective date at the top
of the page and, where appropriate, notify users through the
Services. Continued use of the Services after changes take
effect constitutes acceptance of the updated Terms.
